This online toolkit provides a detailed and up-to-date summary of federal and California law to help residential care facilities keep track of and comply with complex wage-and-hour regulations. Residential care facilities have been under increased scrutiny in recent years, particularly in the area of wage and hour compliance. To complicate matters, federal and state laws and regulations continue to evolve at breakneck speed. This toolkit provides:

  1. detailed guidelines that keep pace with these legislative, regulatory, and judicial developments, and
  2. includes answers to Frequently Asked Questions as well as
  3. state-of-the-art sample forms and agreements to help residential care facilities remain in compliance with the ever-changing nature of wage and hour law.

To date, 6Beds has been working diligently with the State of California to change labor laws that negatively impact our industry and later aims to do the same with federal labor laws. But until 6Beds’ legislative efforts succeed, the residential care industry must strive to comply with both federal and state labor laws. In time, as more residential care facilities maintain compliance with these complex laws, it is our understanding that the rampant audits and lawsuits will diminish significantly.

The Department of Labor is hosting a free live online training on the federal wage and hour laws this Thursday at 10 am. Topics covered will include best practices and typical mistakes made by residential care home owners that can lead to hundreds of thousands of dollars in back wages owed to workers. This online presentation will have a live video feed of the presenter and will have time for questions form the participants.

Wage and Hour Guide and Sample Agreements for Residential Care Facilities: Compliance with Federal and California Wage and Hour Laws

The Wage and Hour Guide and Sample Agreements for Residential Care Facilities will be available on August 1, 2015, for a one-time investment of $950 to 6Beds members, only. All future updates will be provided — free of charge — to all current standing members.

6Beds’ Board of Directors deliberated the value of this document — along with a complimentary training session — based on the cost (both time and money) spent by various legal experts at Littler Mendelson and select 6Beds officers.  For those members who believe they should get this guide for free, the Board has determined that $950 is a very reasonable and fair price, considering that many in our profession have paid over $5,000 to $10,000 to have attorneys prepare a 24-Hour Caregiver Live-In Agreement — which nowhere nears the extensive research and industry-customization Littler has invested in producing our latest labor compliance guide. That being said, 6Beds’ Wage and Hour Guide and Sample Agreements for Residential Care Facilities will be the new state of the art standard for California’s residential care industry, to come. It is authored and backed by the world’s top labor law firm, designed specifically for residential care facilities.

We understand that $950 is not a trivial sum. However, no one in our profession can obtain such in-depth and industry-relevant legal guidelines and sample agreements (along with annual updates) from an attorney at that price. Dear 6Beds Members & Leaders,

Think back to one year ago, just one year since our 6Beds organization was founded, and there was no organization that was the voice of our 6Bed Residential Care industry.  There was no place for legislators to turn to seek an opinion on a particular piece of legislation, no place for DSS/CCL to go for views of  six bed residential care owners and no place for labor, both federal and state to seek cooperation and work together to educate business owners of the complicated requirements of labor law.  NOW THERE IS.  In the forty (40) year history of our industry, this is a first.  There has never been a professional state-wide organization that represented just Residential Care facilities.  HOW DID IT HAPPEN?

How did 6Beds grow in just one year to be recognized by the California legislature and Governor Brown’s administration, become Stakeholders of DSS and DDS  and earn the respect of federal and state labor as the responsible voice of the  Six Bed Residential Care industry for the Elderly, Developmentally Disabled and Mentally Ill?

It happened because all of you supported it with your membership and dozens and dozens of leaders gave their time and worked together unselfishly to educate the legislature, the administration, DSS, DDS and Labor about the unique issues of our industry.  It happened because we hired one of the best  most respected lobbyist teams in Sacramento.  It happened because we hired the number one labor law firm in the world representing only the employer.  It happened through three rallies at the State Capitol, where hundreds of you came from all across the state to demonstrate solidarity.   It happened through participation in DSS stakeholder meetings. It happened through Littler’s professional development of our Compliance Model and labor’s awareness of that.  It happened through leadership meetings with federal and state labor enforcement executives.  It happened through the skilled efforts of our lobbyists arranging meetings with important state senators, assembly members and their key staff, and with the governor’s staff and cabinet member’s key staff and their tireless follow-up for reinforcement.

All of this is something very special, something significant to be proud of and to celebrate, which we will do on August 1, 2015 at the Long Beach Marriott.   For this event we will have a beautiful Commemorative Souvenir Program.   This is your chance to have your facility recognized in this document and show your continued support of what we are achieving together.  Please click here to download the advertisement agreement.
