6Beds Continues to Push the Envelope for the Residential Care Communities

6Beds 2018 Advocacy Day, on April 11th, was a great success and serves as a new benchmark for this trailblazing organization—in terms of guest speakers presenting, new membership sign-ups and renewals, as well as putting the must-have Wage and Hour Guide in the hands of operators.

Now in its fourth year since its meteoric inception in mid-2014, 6Beds has proven its ability to affect categorical, positive change in the residential care industry and, in the process, has garnered high praises and respect from the Department of Social Services (DSS), Department of Developmental Services (DDS), Department of Labor (DOL), Division of Labor Standards and Enforcement (DLSE), numerous politicians, residential care operators and the countless communities 6Beds serves throughout California.

6Beds’ stellar lobbyists, Robert Naylor and Roxanne Gould kicked off the event—welcoming over 140 attendees and introducing this years’ 6Beds sponsored bill, AB2744: Referral Agency, as the centerpiece to 6Beds’ Grow the 6! theme for this year’s advocacy day.

Both Naylor and Gould reinforced 6Beds’ well-seasoned volunteer leadership’s vital role in protecting and advancing the residential care industry to ensure housing and care for California’s frail elderly and adults with developmental disabilities. Watch clips below:

Naylor and Gould then fielded questions about AB2744 and detailed the steps we still need to take before the bill lands on the Governor’s desk.

They were followed by Ron Simpson, 6Beds Director, Southern California President and Compliance & Membership Director, who gave an overview of how 6Beds came about in sponsoring AB2744 and the important roles 6Beds’ lobbyists played in authoring the bill. Watch all four clips below:

The attendees then had the pleasure of hearing from the primary author of AB2744, Assemblymember Eloise Reyes (D-Inland Empire), who dropped in to express her support and reason for authoring this very important bill. Watch clip below:

In addition to sponsoring AB2744, Cyndy Minnery, 6Beds Director and Senior Vice President of Clinical Affairs & Compliance, and George Kutnerian, 6Beds Director and Senior Vice President of Public Policy & Legislation, are collaborating on a forthcoming medication management training bill — to train RCFE caregivers on how to administer medications to residents during their end-of-life phase.

Next, Kutnerian provided an update on last year’s 6Beds sponsored bill, AB1437: Modernizing Regulations. Learn how this bill will simplify the way you obtain caregiver security clearance for the multi-facilities you operate. Watch clip below:

This year, 6Beds had the privilege of having two top officials from the DSS participate in a round table discussion, moderated by Kutnerian, to talk about the latest issues surrounding our industry. They are Pam Dickfoss, Deputy Director, DSS, Community Care Licensing and Ley Arquisola, Program Administrator, Adult and Senior Care Program. Since topics covered are significant in content and length, we will provide each in a separate blog. Be on the lookout for these in the coming days.

Taking time off from their impacted schedules, Senator Scott Wiener (D-San Francisco), co-author of last year’s 6Beds sponsored bill, AB1437, as well as Senator Joel Anderson (R-San Diego), staunch supporter of small business and 6Beds, dropped by to give their support to 6Beds and to all care home operators throughout California. With a short time in between, Attorney Roberta Mendonca presented 6Beds Foundation — 6Beds’ sister organization. Watch Mendonca’s presentation below to learn more about this exciting new non-profit organization whose purpose is to utilize existing residential care homes to solve California’s housing crisis for the frail elderly and adults with developmental disabilities.

Rounding out the day was a joint DOL/DLSE Labor Training session. This was yet another rare occasion where we had both federal and state representatives provide a comprehensive perspective on the federal and state labor laws that govern our caregivers.

For 6Beds members, however, the day was far from over. Gina Wasdyke, 6Beds Director and Founder, shared her industry-know-how to encourage and inspire both veteran and newly-initiated ARF and RCFE operators with a range of untapped and under-utilized opportunities, as well as funding sources in the residential care industry.

Dozens of ARF and RCFE Providers Honored at Red Carpet Gala! (see pix and vids)

On August 19, 2017, 6Beds celebrated its third year anniversary with an evening of awards, honors and festivities at Long Beach Marriott in Southern California. The red-letter event highlighted both 6Beds’ advances for the residential care industry and honored eight ARF and thirty-three RCFE providers for their decades of dedicated service to the elderly, adults with developmental disabilities and the mentally ill.

These awards and recognitions are long overdue and well deserved. They shine a light on the important work that we do as residential care providers, as well as apprise politicians and lawmakers of our vital contributions within our communities. See photos and video clips below.

Senator Scott Weiner (D-San Francisco), principal co-author of 6Beds’ first-ever sponsored bill, AB 1437, was the evening’s guest speaker and award presenter. Fellow co-author of AB1437, Assemblyman Jim Patterson (R-Fresno), was not able to attend due to an unforeseen circumstance.

Until 6Beds, there was no definitive and effective representative of the economic and political interests of residential care home owners at the State Capitol. Today however, according to Senator Weiner, …it’s terrific that you (care home owners) now have a very, very effective voice and presence in Sacramento. It just makes a world of difference when there are people we as legislators can work with, pick up the phone and call or meet with and ask questions…And you have that (with 6Beds) and is incredibly valuable.

6Beds’ lobbyist, Roxanne Gould, also spoke and echoed Senator Weiner’s sentiments. Three years ago you didn’t have a voice in Legislature. Three years ago, there were a myriad of horrible bills that were going to specifically hurt this particular segment…, said Gould. She went on to say, It is really monumental that in our third year, we are introducing legislation and passing it through…We are going to get stronger, we are going to get represented…even more as we go forward, which can’t be done without all of you…

George Kutnerian, 6Beds Senior Vice President of Public Policy and Legislation, gave an update on AB1437 and emphasized the importance of 6Beds’ growing rapport and relationships with lawmakers such as Senator Weiner, Assemblymember Patterson, Assemblymember Rob Bonta (D-Alameda) and many others, without whose support and understanding of our industry we could not have authored AB1437. As you may know, you can sponsor a bill, but without an author then you don’t have a bill, said Kutnerian. He further stated that in addition to legislation reforms, 6Beds also monitors and challenges proposed regulation updates that may be harmful to our industry, such as the reduction of the long-standing 30-day resident notice to 5 days, that is in the admission agreements, under Title 22. According to Kutnerian, 6Beds argued and won to keep the 30-day notice. A significant victory for us all.

2-Year Celebration Highlights 6Beds Accomplishments and Visionaries

On August the 27th, 6Beds leaders and members gathered at the Embassy Suites Waterfront Hotel in Burlingame to celebrate the culmination of 2 years of hard work and the successful political and operational establishment of the organization as a force in the RCFE and ARF community.

Led by Gina Wasdyke and Olivia DeAnda — who headed the organizational committee of volunteers — 6Beds members and 6Beds VC members met during the day to discuss the Wage and Hour Guide for Residential Care Facilities. Presenters included opening remarks by Board Member, Dr. Ron Simpson, followed by Board Member, George Kutnerian, who delivered an illuminating presentation on 6Beds policy and legislative updates. Representatives from the DOL and the DDS gave us their insights on issues relating to personnel and regulatory changes that affect RCFE and ARF operators.

The day conference and the evening gala was attended by more than 500 care homeowners and vendors. The evening gala enjoyed a festive and well-earned evening of dinner, music and dancing in the elegant setting of the hotel’s Ambassador Ballroom.

Highlights of the party included awards to more than 15 outstanding members who have provided incredible service over many decades to the cause of providing personalized, loving care to thousands of residents.

Our 2016 Caregiver of the Year Award was presented with tremendous applause to Flordeliza Pascua for a lifetime of service to the elderly and adults with developmental disabilities and mental illness. We cannot begin to express our gratitude to Flordeliza for her incredible dedication and perseverance. The award was one of the highlights of the night!

Other honorees included Eufemia Romero Abaya, Lucy Romero Nicario and Elvira Romero in recognition of more than 50 years of service to the frail and the elderly and adults with developmental disabilities.

Our 30 Year Honorees were Greg and Diana Hernandez (ARF-DD) and Carmelita Pineda (ARF-MI). Other 30 Year Service Awards were presented to Fernando and Lorna Farol, Ovanes and Nazeli Kutnerian and Patrick and Carole Nobis (RCFE).

The city was well represented and plaques of appreciation were presented by San Francisco Supervisor Scott Wiener, Daly City Vice-Mayor David Canepa and Daly City Council Mike Guingona. Other political luminaries included Assembly Member Kevin Mullin, who provided Certificate of Recognition to Honorees.

The keynote speaker at the gala was former California State Assemblyman Robert Wesley Naylor, one of the key members of 6Beds successful and ground-breaking lobbying effort in Sacramento. His upbeat message was a simple one: The RCFE and ARF communities are growing, getting stronger, and the future is extremely bright.

DD ARM Rates Set to Increase July 1, 2016

To our Fellow Provider,

The Department of Developmental Services (DDS) issued the new rate schedule for ARM rate providers — effective July 1, 2016 — with at least a 7.75% rate increase for community care facilities caring for 5 or more residents and a 25% increase for facilities serving four or less. This is a significant rate increase which is long overdue!

While this milestone was brought about by a collective effort among various organizations, it is undeniable that 6Beds played a huge role in making it happen. Since its inception in July of 2014, 6Beds rallied en masse, testified in various hearings and lobbied fiercely at the State Capital to get our messages across to our legislators and the Governor’s office.

That said, we thank various 6Beds leaders, many of whom are ARF DD and RCFE DD providers who were quite passionate in expressing our community’s financial needs throughout various hearings and meetings. They are Reshema Hollinsworth, Dr. Don Turner, Gina Wasdyke, George Kutnerian, Dr. Ron Simpson, Nestor Uy, Frank Dickey and Mark Alipio. We also thank 6Beds lobbyists, Robert Naylor and Roxanne Gould for their instrumental support and input. However above all, we thank you — our 6Beds members — without whose continued financial support we could not have achieved these significant rate increases that have eluded our facilities for far too many years.

We also thank the Governor’s office, DDS and many legislators, especially Assemblymember Thurmond of Richmond and Assemblymember Bonta of Oakland/Alameda, Senator Mitchell of Culver/Los Angeles for recognizing that the current stagnant rates needed to be raised to ensure that our care homes continue to care for Californians with developmental disabilities.

Who we are and our meteoric ascent…

Fellow care home provider,

We are 6Beds, Inc., comprised of dedicated care home providers such as you, who are deeply concerned that the current California legislation and labor laws may eventually lessen our capacity to provide the best care for our residents and ultimately erode the viability of our small business.

The recent 2014 RCFE Reform Act—authored to revamp our industry’s directives—along with current federal and California labor laws, have already forced over 500 homes to close since early this year. Today, with over 11,000 six-bed care homes throughout California, our industry provides care to over 37,000 elderly and over 26,000 developmentally disabled adults.

With our industry forecasted to grow exponentially over the next two decades, you can expect more proposed regulatory legislation that may infringe on how we conduct our business. According to Ken Smith, a director at the Stanford Center of Longevity, by the year 2032, Americans over age sixty-five will outnumber those under age fifteen—making up a huge chunk of the marketplace.

To that end, many of your fellow care home providers banded together and formed 6Beds, Inc. on July 1st of this year. As a nonprofit, mutually benefit advocacy group registered with the State of California, we promote safe and affordable quality care for California seniors and disabled adults in a home-like environment. We advocate and educate on behalf of California’s vulnerable residents by uniting senior and adult care facilities throughout the state.

Since our inception we have trail blazed a path for our industry never before seen in California’s history. Today—in a very short time—our lawmakers and politicians are listening to us. More than that, we are impacting key legislation in our industry. As the only recognized stakeholder representing RCFE and ARF residential care homes by the Department of Social Services (DSS) and the Department of Labor (DOL), our influence—your influence—has never been more impactful in California’s legislative body than it is today.

With that in mind, we must work collectively to refine the 2014 RCFE Reform Act that has just passed, specifically to recall

  1. the Death Refund Bill,
  2. the requirement to maintain a one-to-three million commercial liability policy and
  3. the significantly higher civil penalties that is unproportional to six bed facilities relative to the larger assisted living facilities.

Furthermore, we have engaged California’s labor department in a dialogue, and we strive to do the same with the federal labor department to

  1. halt the labor auditor’s aggressive labor compliance investigations, and
  2. curtail their application of exorbitant monetary penalties, until the confusion surrounding these issues is resolved.

Our aim is to draft legislation that supports the live-in model in order to preserve the continuity of care within the residential care facilities.

That being said, we need your help.

We urge you to join our fast-growing group—actually, your group—of over 1,000 licensed care homes, statewide (whether as a member and/or as an active participant in our rallies, events, discussions, etc.) as we march forward into the future to insure that the level of care we provide will always be available to our elders and adults with developmental disabilities.

Only by coming together, can our voices be heard and our rights preserved. Our cause must be constantly represented and at the top of our lawmakers’ minds as they promulgate new laws—shaping the landscape of our industry to come. It is imperative that we set all our differences and indifferences aside, for we are all on the same side. We all want what is best for our industry and for those whom we serve.

6Beds, Inc. Milestones

Through 6Beds, our reputation and public perception changed overnight from mostly timid immigrants—who barely spoke English—to intelligent, educated and articulate small care home owners. Our governor, state legislators, Department of Social Services (DSS) and Department of Labor (DOL) are listening to us and finally taking us seriously as a stakeholder in our industry. With the help of your dedicated, fellow care home providers, here is how we did it:

  • On July 1, 2014, 6Beds, Inc. was registered as a non-profit, mutual benefit corporation, with the State of California.
  • On August 1, 2014, with 6Beds’ board of directors and team leaders in place, we
    • hired 3 political lobbyists registered with the Secretary of State. They are:
      1. Atty. Robert Naylor, a Stanford and Yale graduate and a former assembly member of San Mateo,
      2. Roxanne Gould, a seasoned lobbyist, and
      3. Tricia Hunter, a registered nurse and currently the executive director of the American Nurses Association (ANA) and also a former CA assembly member;
    • hired Beth Miller Group, a well-respected public relations team in Sacramento;
    • hired an accountant and an in-house lawyer that specializes in non-profit organizations.
  • On August 5, 2014, 6Beds—backed by over 500 statewide care providers—lobbied for the first time at the California State Capitol. As a result, many amendments were added to the seventeen bills comprising the 2014 RCFE Reform Act. (Read all about it here: http://6beds.org/rcfe-reform-act-of-2014/)
  • On September 23, 2014, 6Beds directors and leaders had its first strategic planning meeting with California Regional Manager of Labor, Benny Cheng, to discuss labor issues within our industry. From this point forward, the California’s Department of Labor (DOL) recognized 6Beds, Inc. as the only stakeholder representing Residential Care Facility for the Elderly (RCFE) and Adult Residential Facility (ARF) residential care homes.
  • On October 1, 2014, the San Francisco-based, Philippine Consulate, invited and met with 6Beds leaders to discuss California’s labor laws and its negative impact on the six-bed residential care homes.
  • On October 21, 2014—represented by 25 key leaders statewide—6Beds leaders met with DSS Deputy Chief Pam Dickfoss, and RCFE and ARF Administrator, Mary Jolls. From this point forward, California’s Department of Social Services (DSS) recognized 6Beds, Inc. as the only stakeholder representing RCFE and ARF residential care homes.
  • On October 29, 2014, with less than one week of planning, 6Beds sponsored a labor rally: Let’s Talk Labor at the State Capitol. Over 300 statewide care providers attended to show their support. Along with them, various caregivers also attended to show their support. For the very first time, care providers came forward to share their labor-related experiences.
  • On November 14, 2014, 6Beds leaders met with DSS statewide regional managers, to initiate partnership and collaboration on many projects to improve the residential care system.
  • On November 19, 2014, 6Beds hired Littler Law Firm (one of our nation’s top labor and employment law firms) to help guide and navigate our course of action when dealing with California’s Labor Department to address labor laws that cripple our industry.

As we gain momentum, our tireless efforts continue…

  • Along with Littler Law Firm, 6Beds leaders will start negotiations with California’s Department of Labor.
  • Upcoming meeting with DDS’s Santi Rogers will start the dialogue on issues surrounding DD.
  • Dialogue with Federal Department of Labor is confirmed to start second week of December.
